These Terms of Service apply to your access to and use of edu.aussieanimals.com and any related educational resources, downloadable files, digital products, licences, accounts, content, communications and services provided by About Time Too Pty Ltd trading as Aussie Animals.

In these Terms, “Aussie Animals”, “we”, “us” and “our” means About Time Too Pty Ltd trading as Aussie Animals. “You” and “your” means the person, school, organisation, parent, carer, homeschool educator or other user accessing or purchasing from the Service.

By accessing the Service, creating an account, purchasing a product, downloading a resource or using our materials, you agree to these Terms.

These Terms should be read together with our:

If there is any inconsistency between these Terms and specific Licence Terms for a product, the specific Licence Terms will apply to the extent of the inconsistency.

1. About the Service

Aussie Animals Education provides educational resources, printable worksheets, digital downloads, teacher guides, classroom activities, curriculum-aligned packs, homeschool resources and related educational materials.

The Service is designed to support Australian teachers, schools, relief teachers, homeschool families, parents, carers and educational organisations.

Our resources may include Australian animals, habitats, science, sustainability, English, mathematics, HASS, geography, health and safety, visual arts and related educational topics.

2. Intended users and age requirements

The Service is intended for use by adults, including teachers, school staff, parents, carers, homeschool educators and authorised representatives of schools or organisations.

You must be at least 18 years old to:

  • create an account;
  • purchase a resource;
  • download paid resources;
  • enter into a licence agreement;
  • subscribe to paid services;
  • submit payment information; or
  • communicate with us in relation to purchases, licences or accounts.

Students are not required or permitted to create accounts, make purchases, submit personal information, upload content or otherwise interact directly with the Service.

Students may use printed or digitally supplied learning materials only where those materials are provided to them by a teacher, parent, guardian, school or authorised adult in accordance with the applicable licence.

3. Acceptance of these Terms

You accept these Terms when you:

  • access or use the website;
  • create an account;
  • purchase a product;
  • download a free or paid resource;
  • tick a checkbox agreeing to these Terms;
  • use a resource supplied by Aussie Animals; or
  • continue using the Service after being notified of changes to these Terms.

If you do not agree with these Terms, you must not use the Service or download our resources.

If you are using the Service on behalf of a school, business, organisation or other entity, you confirm that you are authorised to accept these Terms on behalf of that entity.

4. Accounts

You may need to create an account to purchase, access or download some resources.

You are responsible for:

  • ensuring your account information is accurate and current;
  • keeping your login details secure;
  • all activity that occurs under your account;
  • notifying us promptly if you believe your account has been accessed without authorisation; and
  • ensuring that your use of the Service complies with these Terms and any applicable licence.

You must not:

  • share your login details with people outside your licence;
  • allow students to use your account;
  • create an account using false or misleading details;
  • impersonate another person or organisation;
  • use another person’s account without permission; or
  • attempt to bypass licence limits or access restrictions.

5. School and organisational accounts

Where a school, campus, department, organisation or team purchases a licence, the licence applies only to the permitted users described in the licence purchased.

Unless otherwise stated in writing:

  • a Single Teacher Licence is for one individual educator;
  • a Small Team Licence is for use by the number of educators stated at purchase;
  • a Whole School Licence is for staff within one school campus only;
  • a licence does not extend to multiple campuses, school networks, districts, education departments, tutoring chains or unrelated organisations unless expressly stated;
  • resources must not be shared outside the licensed group.

Schools and organisations are responsible for ensuring that staff understand and comply with these Terms and the applicable licence.

6. Student use and student information

The Service is not designed to collect personal information directly from students or children.

You must not upload, submit or send us student personal information unless we have expressly agreed in writing and appropriate privacy arrangements are in place.

This includes, but is not limited to:

  • student names;
  • student email addresses;
  • student identification numbers;
  • student photographs;
  • student work samples;
  • assessment records;
  • behaviour records;
  • health information;
  • disability or support needs;
  • sensitive information;
  • school reports; or
  • any other information that could identify a student.

If you contact us for support, you should avoid including student personal information. Where examples are required, you should de-identify the information before sending it to us.

If we become aware that student or child personal information has been provided to us without appropriate authority, we may delete, de-identify or return that information, unless we are required by law to retain it.

7. Educational use

Our resources are provided for educational and informational purposes.

Teachers, schools, parents, carers and homeschool educators are responsible for determining whether a resource is suitable for:

  • the age and year level of students;
  • curriculum requirements;
  • classroom context;
  • student learning needs;
  • cultural context;
  • safety requirements;
  • school policies;
  • local laws and regulations; and
  • any applicable accessibility, inclusion or wellbeing requirements.

We make reasonable efforts to provide accurate, age-appropriate and useful educational content, but we do not guarantee that every resource will be free from error, meet the specific requirements of every school, curriculum program, student group or teaching context.

8. Curriculum alignment

Some resources may refer to the Australian Curriculum, state or territory curriculum links, learning areas, year levels, achievement standards, content descriptions or curriculum codes.

We make reasonable efforts to ensure curriculum references are accurate at the time of publication. However, curriculum frameworks, codes, descriptions and interpretations may change over time.

You are responsible for checking that a resource remains suitable for your teaching program, school requirements and curriculum obligations.

Curriculum alignment statements are provided as guidance only and do not guarantee approval, endorsement or accreditation by any curriculum authority, education department or school system.

9. Wildlife, outdoor learning and safety content

Some resources may include wildlife, outdoor learning, habitat, conservation, animal safety, field observation, nature study or related topics.

These resources are for educational purposes only and are not a substitute for professional safety advice, school risk assessment, first aid advice, wildlife handling guidance, emergency advice or legal requirements.

Students should not approach, handle, feed, disturb or interfere with wildlife.

Adults are responsible for:

  • supervising students;
  • conducting risk assessments;
  • following school policies;
  • following local wildlife and environmental laws;
  • checking local hazards;
  • obtaining required permissions;
  • using safe outdoor learning practices; and
  • adapting activities to suit the learning environment.

If a resource discusses potentially dangerous animals, venomous species, bites, stings, water safety, heat, remote environments or other hazards, the content is general educational information only.

In an emergency, contact the relevant emergency services.

10. Purchases and payments

Prices are displayed in Australian dollars unless otherwise stated.

Prices may include or exclude GST depending on the display settings shown at checkout. The total price payable will be shown before you complete your purchase.

We may change prices, product inclusions, licence options, bundles or promotions at any time. Price changes do not apply retrospectively to completed purchases unless required by law.

Payment must be made using the payment methods available at checkout.

You must ensure that:

  • your billing information is accurate;
  • you are authorised to use the payment method;
  • payment details are not fraudulent or unauthorised; and
  • any purchase made on behalf of a school or organisation is properly authorised.

Where a product is sold as a fixed-term licence, subscription or membership, the duration, renewal terms and update access will be shown at or before purchase. A 12-month Small Team Licence or Whole School Licence gives access to updates during the active licence period only, unless otherwise stated.

We may refuse, cancel or suspend an order if we reasonably believe it is fraudulent, unauthorised, in breach of these Terms, affected by a pricing or technical error, or otherwise inappropriate.

11. Digital delivery

Most products are delivered digitally by download, account access, email link or another digital method.

You are responsible for ensuring that you have suitable software, devices, internet access and technical capability to download, open, print and use the resources.

We are not responsible for issues caused by:

  • your device;
  • your printer;
  • your internet connection;
  • your software;
  • school network restrictions;
  • firewall or security settings;
  • third-party applications;
  • user error; or
  • incompatible file handling.

If you have difficulty accessing a purchased resource, contact us and we will take reasonable steps to assist.

12. Licence to use purchased resources

When you purchase or download a resource, you do not purchase ownership of the copyright or intellectual property in that resource.

Instead, you receive a limited, non-exclusive, non-transferable licence to use the resource in accordance with the licence type purchased or granted.

Unless otherwise stated, you may:

  • download the resource for your permitted use;
  • print copies for use with your own students, class, homeschool group or licensed users;
  • display the resource in your classroom or learning environment;
  • use the resource for direct teaching, planning, revision, relief teaching or homeschool learning;
  • store a reasonable copy for your own permitted future use; and
  • adapt classroom delivery to suit your students, provided you do not remove copyright notices or claim the resource as your own.

Your exact rights depend on whether you purchased a Single Teacher Licence, Small Team Licence, Whole School Licence or another licence type.

13. Licence restrictions

Unless we give written permission, you must not:

  • resell our resources;
  • redistribute our resources outside your licence;
  • upload our resources to public websites;
  • upload our resources to file-sharing platforms;
  • upload our resources to public social media groups;
  • upload our resources to shared drives accessible outside your licensed group;
  • share paid resources with unlicensed teachers, schools or organisations;
  • claim our resources as your own;
  • remove copyright notices, branding or attribution;
  • use our resources to create competing products;
  • sell printed copies of our resources;
  • include our resources in commercial tutoring packages without the appropriate licence;
  • use our resources in paid courses, memberships or subscription platforms without written permission;
  • use our resources for training artificial intelligence models;
  • extract illustrations, text, worksheets, layouts or templates for reuse in other products;
  • systematically scrape, copy or download website content;
  • bypass download limits, licence restrictions or access controls; or
  • use the Service in any unlawful, misleading, harmful or unauthorised way.

14. Free resources

We may provide free resources from time to time.

Free resources remain protected by copyright and are subject to these Terms unless different terms are stated.

You may use free resources for personal, classroom, homeschool or permitted educational use, but you must not resell, redistribute, upload publicly, claim ownership of or use them to create competing products.

We may modify, remove or discontinue free resources at any time.

15. Subscriptions, memberships and renewals

Some Aussie Animals Education products may be sold as one-off purchases, fixed-term licences, subscriptions or memberships.

The product page, checkout page, invoice or written offer will state the licence type, duration, inclusions, renewal terms, update access and pricing that apply to your purchase.

15.1 One-off purchases

A Single Teacher Licence is a one-off purchase of the current version of the resource, unless otherwise stated.

Single Teacher Licences do not include future updates, revised versions, expanded versions, new editions or subscription-only improvements unless this is expressly stated on the product page, checkout page, invoice or written offer.

15.2 Fixed-term licences

Small Team Licences and Whole School Licences are fixed-term 12-month licences, unless otherwise stated.

During the active 12-month licence period, Small Team and Whole School Licence holders may access updates, corrections or revised versions of the purchased resource that we make available to active licence holders.

When the 12-month licence period ends:

access to new updates, revised files and future versions ends unless the licence is renewed;

you may continue using copies already downloaded during the active licence period, provided use remains within the applicable Licence Terms;

you must not expand use beyond the original licence scope, user limit, campus or organisation unless the licence is renewed, upgraded or replaced.

A fixed-term licence is not the same as a recurring subscription unless the product page or checkout process clearly states that automatic renewal applies.

15.3 Subscriptions and memberships

If we offer subscriptions or memberships, the specific terms, inclusions, renewal period, cancellation rights and pricing will be shown at the time of purchase.

Unless otherwise stated:

subscriptions provide access only while the subscription is active;

membership access may end when the membership expires or is cancelled;

subscription or membership pricing may change with notice;

you are responsible for cancelling before renewal if you do not wish to continue;

cancellation does not automatically entitle you to a refund for the current billing period unless required by law.

15.4 Renewals

If a licence, subscription or membership is renewable, the renewal terms will be shown at or before purchase.

Where automatic renewal applies, we will aim to make this clear before purchase, including the renewal amount, renewal period and cancellation method.

If automatic renewal is not enabled, your access to updates, subscription-only content or membership benefits may end when the licence, subscription or membership period expires.

15.5 Australian Consumer Law

Nothing in these Terms limits your rights under Australian Consumer Law.

We will not use unclear cancellation processes or terms that attempt to remove rights available under Australian Consumer Law.

16. Refunds and Australian Consumer Law

Our products and services come with rights under the Australian Consumer Law that cannot be excluded, restricted or modified.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

You may be entitled to a refund, replacement, repair or other remedy if a product or service fails to meet a consumer guarantee. The ACCC explains that consumers are entitled to remedies where products or services do not meet basic consumer guarantees.

Because many of our products are digital downloads, we generally do not provide refunds for change of mind once a resource has been downloaded or accessed, unless required by law.

We may consider refunds or replacement access where:

  • you purchased the same product twice by mistake;
  • a technical issue prevents access and we cannot reasonably resolve it;
  • the wrong file was supplied;
  • the product description was materially inaccurate;
  • the file is defective; or
  • a refund is required under Australian Consumer Law.

To request assistance or a refund, contact us with your order details and a description of the issue.

17. Product descriptions and availability

We aim to describe our products clearly and accurately. However, minor differences may occur between product descriptions, preview images, file names, page counts, included activities, curriculum references or final downloaded files.

We may update, improve, correct, replace, bundle, unbundle or discontinue resources at any time.

We do not guarantee that a resource will remain available indefinitely.

If a product has been materially changed after purchase, access to the updated version depends on the licence purchased. Single Teacher Licences do not include updates unless expressly stated. Small Team and Whole School Licences include access to available updates during the active 12-month licence period only. We are not required to provide free lifetime updates unless expressly stated at the time of purchase.

18. Intellectual property ownership

Unless otherwise stated, all resources, worksheets, teacher guides, lesson materials, illustrations, product descriptions, downloadable files, website content, branding, logos, design elements, templates, layouts, images, graphics, text, metadata and other materials made available through Aussie Animals Education are owned by or licensed to About Time Too Pty Ltd trading as Aussie Animals.

These materials are protected by copyright, trade mark and other intellectual property laws.

Purchasing, downloading or using a resource does not transfer ownership of copyright or intellectual property.

You receive only the licence rights expressly granted under these Terms and the applicable Licence Terms.

All rights not expressly granted are reserved.

19. User content, feedback and suggestions

The Service is not designed to collect student work, student records or student personal information.

If you provide feedback, suggestions, corrections, reviews, testimonials, comments, questions, ideas or other content to us, you retain ownership of any intellectual property you own in that content.

You grant us a limited, non-exclusive, royalty-free licence to use that content for the purpose of:

  • operating the Service;
  • responding to you;
  • improving resources;
  • correcting errors;
  • providing support;
  • developing new products;
  • displaying reviews or testimonials, where appropriate; and
  • promoting the Service.

We will not claim ownership of classroom work, student work or school-owned content.

You must not provide content that:

  • infringes another person’s rights;
  • contains student personal information without authority;
  • is unlawful, defamatory, misleading, abusive or harmful;
  • contains confidential school, student or employer information;
  • contains malware or harmful code; or
  • breaches these Terms.

We may remove or refuse to publish user content at our discretion.

20. Trade marks and branding

The names Aussie Animals, Aussie Animals Education, associated logos, product names, branding, design elements and related marks are owned by or licensed to us.

You must not use our trade marks, branding or logos without written permission, except where reasonably necessary to identify a purchased resource in ordinary educational use.

You must not suggest that we endorse your school, business, product, service, course, website or organisation unless we have agreed in writing.

21. Third-party content and links

The Service may include links to third-party websites, platforms, tools, videos, references, curriculum pages, government websites, payment services, email systems or other external services.

Third-party websites and services are not controlled by us.

We are not responsible for:

  • third-party content;
  • third-party privacy practices;
  • third-party terms;
  • third-party availability;
  • third-party security;
  • third-party accuracy; or
  • any loss or issue arising from your use of third-party services.

You should review the terms and privacy policies of any third-party service you use.

22. Privacy

Your use of the Service is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, hold, use and disclose personal information.

The Australian Privacy Principles require covered organisations to have a clearly expressed and up-to-date privacy policy about the management of personal information, and APP 1.4 sets out the kinds of information an APP privacy policy must contain.

By using the Service, creating an account or making a purchase, you acknowledge that you have had an opportunity to read our Privacy Policy.

Where required, you may be asked to actively agree to the Privacy Policy before creating an account, making a purchase or using particular parts of the Service.

23. Cookies, analytics and security tools

We may use cookies and similar technologies to:

  • operate the website;
  • manage account sessions;
  • process ecommerce functionality;
  • remember preferences;
  • improve performance;
  • analyse website usage;
  • detect errors;
  • prevent fraud;
  • protect website security; and
  • support marketing where permitted.

You can manage cookies through your browser settings, although some website features may not work properly if cookies are disabled.

24. Acceptable use

You must use the Service lawfully and responsibly.

You must not:

  • breach these Terms;
  • infringe intellectual property rights;
  • interfere with website security;
  • attempt unauthorised access;
  • scrape, crawl, harvest or systematically copy content without permission;
  • use bots or automated tools to access the Service without permission;
  • introduce malware or harmful code;
  • overload or disrupt the website;
  • bypass payment, licence or download restrictions;
  • use the Service for fraudulent purposes;
  • misuse discount codes or promotions;
  • submit false, misleading or unlawful information;
  • upload or send student personal information without authority;
  • harass, abuse or threaten us or others;
  • use the Service in a way that damages our reputation; or
  • use the Service for any unlawful, harmful or unauthorised purpose.

25. Accessibility

We aim to make our resources and website clear, practical and accessible where reasonably possible.

However, not all resources may be suitable for every accessibility need, device, assistive technology or learning context.

Teachers, schools, parents and carers are responsible for adapting resources for individual students where necessary.

If you identify an accessibility issue, you may contact us and we will consider reasonable improvements.

26. Accuracy and errors

We aim to provide accurate and useful educational content, but errors may occur.

This may include errors in:

  • spelling;
  • grammar;
  • page numbers;
  • curriculum references;
  • facts;
  • links;
  • product descriptions;
  • file names;
  • prices;
  • images;
  • metadata; or
  • download files.

We may correct errors at any time.

Some resources may be created or improved using AI-assisted tools. AI-assisted content is reviewed before publication, but errors may still occur. Users should check resources for suitability before use.

If you identify an issue in a purchased resource, contact us and we will consider whether a correction, replacement file or other remedy is appropriate.

27. No professional advice

Our resources are educational materials only.

They do not constitute:

  • legal advice;
  • medical advice;
  • psychological advice;
  • safety advice;
  • first aid advice;
  • veterinary advice;
  • wildlife handling advice;
  • curriculum authority advice;
  • professional teaching accreditation advice; or
  • school compliance advice.

You should seek appropriate professional advice where required.

28. Service availability

We aim to keep the Service available, secure and functional, but we do not guarantee uninterrupted access.

The Service may be unavailable due to:

  • maintenance;
  • technical issues;
  • hosting issues;
  • cyber incidents;
  • internet outages;
  • software updates;
  • third-party service failures;
  • payment provider issues;
  • security controls;
  • force majeure events; or
  • circumstances beyond our reasonable control.

We may modify, suspend or discontinue any part of the Service at any time.

29. Account suspension and termination

We may suspend or terminate an account if we reasonably believe that:

  • you have breached these Terms;
  • you have breached a licence;
  • payment has failed or been reversed;
  • your account has been used fraudulently;
  • your account has been accessed without authorisation;
  • you have misused the Service;
  • you have infringed intellectual property rights;
  • you have shared resources outside your licence;
  • you have attempted to bypass access controls;
  • you have uploaded or sent inappropriate information;
  • your use may harm us, schools, students, other users or third parties;
  • suspension is needed for security reasons; or
  • we are required to do so by law.

Where reasonably practicable, we will give the account holder notice of the issue and an opportunity to respond or remedy the breach before termination.

We may suspend or terminate access without prior notice where we consider it necessary to:

  • protect security;
  • prevent fraud;
  • prevent misuse;
  • comply with law;
  • protect intellectual property;
  • respond to payment abuse;
  • prevent harm; or
  • protect students, schools, users or the Service.

Upon termination, your right to access account-based services may end. Licence rights for resources already lawfully downloaded may continue only to the extent stated in the applicable licence and provided you have not materially breached these Terms.

30. Consequences of breach

If you breach these Terms, we may take one or more of the following actions:

  • issue a warning;
  • request that you stop the breach;
  • request removal of publicly shared or unauthorised copies;
  • suspend downloads;
  • suspend or terminate your account;
  • cancel access to products or subscriptions;
  • refuse future purchases;
  • seek payment for additional licence use;
  • issue a copyright takedown notice;
  • contact your school or organisation where appropriate;
  • report unlawful activity; or
  • take legal action.

We reserve all rights and remedies available under law.

31. Warranties and disclaimers

To the maximum extent permitted by law, the Service and resources are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • the Service will be uninterrupted or error-free;
  • every resource will meet your specific needs;
  • every resource will be suitable for every student;
  • every curriculum reference will remain current;
  • all files will work on every device or software setup;
  • all third-party links will remain available;
  • the Service will be free from all defects or security risks; or
  • every issue will be corrected immediately.

Nothing in these Terms limits your rights under Australian Consumer Law or any other law that cannot be excluded.

32. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or economic loss, including loss of revenue, loss of profit, loss of opportunity, loss of data, loss of goodwill, business interruption or reputational damage.

To the maximum extent permitted by law, our total liability to you in connection with the Service or these Terms is limited to the amount you paid for the relevant product or service giving rise to the claim.

This limitation does not apply to liability that cannot legally be limited or excluded.

33. Indemnity

You agree to indemnify us against any loss, damage, cost, expense or claim arising from:

  • your breach of these Terms;
  • your breach of a licence;
  • your unauthorised sharing or redistribution of resources;
  • your infringement of intellectual property rights;
  • your misuse of the Service;
  • your submission of student personal information without authority;
  • your unlawful conduct;
  • your use of resources in an unsafe or inappropriate way; or
  • your use of the Service on behalf of a school, organisation or third party without proper authority.

34. Promotions, discounts and coupons

We may offer promotions, discounts, coupons, bundles or special pricing from time to time.

Unless otherwise stated:

  • promotions are available for a limited time;
  • promotions may be changed or withdrawn at any time;
  • discounts cannot be applied retrospectively;
  • discounts cannot be exchanged for cash;
  • promotions may be limited to particular products, users or licence types;
  • only one discount may apply per order; and
  • misuse of promotions may result in cancellation of an order or account.

35. Reviews and testimonials

If you submit a review or testimonial, you agree that we may display, edit for length or clarity, and use it for promotional purposes.

We will not knowingly publish personal information about students.

You must not submit reviews that are false, misleading, unlawful, offensive, defamatory, confidential or infringe another person’s rights.

We may remove or decline to publish reviews at our discretion.

36. Email communications

By creating an account, making a purchase or contacting us, you agree that we may send you transactional and service-related emails, including:

  • order confirmations;
  • download links;
  • invoices;
  • account notices;
  • licence information;
  • security notices;
  • support responses;
  • product notices, correction notices or update information related to purchases, where relevant to your licence; and
  • important changes to these Terms or the Service.

We may send marketing emails where you have subscribed, consented or where otherwise permitted by law. You can unsubscribe from marketing emails using the unsubscribe link or by contacting us.

37. Changes to these Terms

We may update these Terms from time to time.

When we make material changes, we will take reasonable steps to notify users, such as by posting the updated Terms on the website, updating the effective date, or providing notice through account or email communications.

Your continued use of the Service after changes take effect means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

38. Assignment

You must not assign, transfer or sublicense your rights or obligations under these Terms without our written permission.

We may assign or transfer our rights and obligations under these Terms as part of a business restructure, sale, merger, acquisition or transfer of assets, provided this is done consistently with applicable law.

39. Force majeure

We are not responsible for delay or failure to perform an obligation where the delay or failure is caused by events beyond our reasonable control, including natural disasters, extreme weather, fire, flood, pandemic, labour disputes, internet outages, hosting failures, cyber incidents, government action, war, terrorism, supply chain issues, third-party platform failures or other events outside our reasonable control.

40. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be severed to the extent necessary, and the remaining parts will continue in full force.

41. No waiver

If we do not enforce a right under these Terms, this does not mean we waive that right.

A waiver must be in writing and signed by us.

42. Governing law

These Terms are governed by the laws of Queensland, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from those courts.
